Before we look to fight a speeding ticket, we need to ask a few questions:
- What kind of charge is it; strict or absolute liability offence?
- At what speed was I recorded at?
- What speed was I charged at, and does this make a difference?
- Was I paced or was speed measuring device used.
- What are the repercussions of this charge: with or without a trial?
- What are my legal rights, now that I am charged?
When you are charged, by the officer who pulled you over, with a speeding offence under 49klms over the posted limit, you will be given a Certificate or Offence which includes a fine. However, if you are charged with the offence of driving at a rate of 50klms or more over the posted limit you will be given a Summons to appear, and your vehicle may be impounded.
Don’t think that just because you were given a small fine for speeding that your troubles are few. Your conviction will be on your driver’s abstract for 3 years from the date of conviction; if you have been assessed demerit points they will be returned 2 years from the date of the offence.
If you have been charged with Part I offence for speeding you now have three choices.
- Pay the Fine. If you pay the fine you are admitting your guilt and accepting the facts as stated in the Certificate of Offence.
- Pleading guilty with explanation
- Request a Trial Date, and you intend to challenge the evidence and perhaps present a defence.
Speeding Ticket Demerit Points by Speeding Range

However, if you are charged with exceeding the posted speed limit by 50klms or more, you are given a date, time and location on the Summons to Appear document which is given to you by the Officer; the Summons can also be sent to you in the mail. Upon conviction you will assessed 6 demerit points, a minimum fine is $2,000 upto a maximum of $10,000, and the court may suspend your license further.
